Eligibility

You must be at least 18 years old and legally able to enter into these terms.

What Flash does

Flash checks links that you submit and returns an informational verdict with supporting evidence. Results reflect the information available when Flash performs the scan.

Flash does not guarantee that a link or site is safe, legitimate, available, or free from harmful content. Results are not legal, financial, security, or other professional advice. You remain responsible for deciding whether to open a link, share information, sign in, make a purchase, or take another action.

Accounts

You must provide accurate account information and keep your account secure. You are responsible for activity under your account. Tell us promptly at support@outtake.ai if you believe that someone has used your account without permission.

Acceptable use

You may not:

• Use Flash for unlawful, fraudulent, harmful, or abusive activity.
• Submit content that you do not have the right to submit.
• Interfere with, disrupt, probe, scan, or test Flash or its security without our written permission.
• Bypass usage limits, access controls, or other safeguards.
• Access or attempt to access another person’s account, data, or systems without permission.
• Overload Flash or use automated means in a way that harms the service or other users.

Ownership and feedback

Outtake and its licensors own Flash, including its software, design, and content. These terms give you a limited, non-exclusive, non-transferable, revocable right to use Flash as permitted by these terms.

You keep ownership of information that you submit. You give Outtake the rights needed to process that information and provide Flash.

If you give us feedback, you allow us to use it without restriction or compensation.

Links and third-party sites

Flash analyzes sites that Outtake does not own or control. Outtake is not responsible for those sites, their content, their availability, or their practices. A verdict or evidence item does not endorse a site.

Availability and changes

We may change, limit, suspend, or stop all or part of Flash. We do not promise that Flash will always be available or error-free. We may set or change usage limits.

Suspension and termination

We may suspend or terminate access if you violate these terms, create risk or legal exposure, or harm Flash or other users. You may stop using Flash at any time.

Disclaimers

To the fullest extent allowed by law, Flash is provided "as is" and "as available." Outtake disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Limitation of liability

To the fullest extent allowed by law, Outtake and its officers, directors, employees, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption arising from or related to Flash.

Some jurisdictions do not allow certain warranty exclusions or liability limits. In those jurisdictions, these provisions apply only to the extent permitted by law.

Indemnity

To the fullest extent allowed by law, you will defend, indemnify, and hold harmless Outtake and its officers, directors, employees, and affiliates from claims, damages, losses, and expenses, including reasonable legal fees, arising from your use of Flash, your violation of these terms, or your violation of another person’s rights.

Governing law

New York law governs these terms, without regard to its conflict-of-law rules. The state and federal courts located in New York County, New York have exclusive jurisdiction over disputes arising from or related to these terms, unless applicable law requires otherwise.

Changes to these terms

We may update these terms. We will post the updated terms on this page and change the effective date. Your continued use of Flash after an update means that you accept the updated terms.
